Offer

This proposal to enter into a paid booking services agreement is a public offer of Prohuahin Rent Co., and is addressed to an indefinite number of persons on the terms set out below.
A person who accepts the Offer (makes an acceptance) is deemed to be the Client who has entered into a paid booking services agreement on the following terms:
TERMINOLOGY:
Acceptance — the person's consent to the terms set out in the Offer. Payment for the services or placing an order through any communication channel (WhatsApp, Telegram, Instagram, the website and the application) constitutes the Client's consent to the terms of this Offer.
Order — a request for a service placed by the Client, created through the booking interface: the website, mobile application, messengers, social networks or other available channels. An Order is considered placed after the Client enters the required data (date, time, route, number of passengers, group specifics, etc.) and confirms the intention to purchase the service.
Product — any type of service published in the Contractor's booking system, including transfers between locations, transport services or combined itineraries without the provision of a guide.
Tour — a transport service including transportation of the Client between specified locations. The Tour does not include a guide, excursion commentary, organisation of activities at locations, or any form of informational or cultural accompaniment. The Tour is purely a logistics service and also includes admission tickets. The Tour is not a tourism service.
Transfer — transportation of the Client from point A to point B according to the route approved in the Order. The price of the transfer does not include additional stops, waiting beyond the agreed time, route changes, or third-party services.
Group specifics — information the Client must provide in advance: number of passengers, presence of children, elderly persons, additional luggage, non-standard suitcases, child seats, animals, wheelchairs, or any other factors that may affect the feasibility or conditions of transportation.
Contractor — the company or person providing the Client with services for organising tours or transfers.
Client — an individual or legal entity that has placed an Order and accepted the terms of the public offer.
Pick-up time — the time agreed between the parties at which the vehicle must be provided to the Client.
Advance payment — a mandatory part of the service price required to confirm the Order. The advance payment reserves the time, vehicle and route.
Order cancellation — the Client's notice of refusal of the service. Cancellation is possible no later than 72 hours before the start of the transfer, unless otherwise specified in the rules of the relevant product.
1. SUBJECT MATTER
1.1. The Contractor provides the Client with a service for organising tours or transfers.
1.2. The Contractor does not provide guide, tour guide, or accompaniment services and is responsible only for transporting the Client from point A to point B, and also organises the purchase of admission tickets.
1.3. The route, vehicle pick-up time, number of passengers and other parameters are determined by the Client when booking.
2. OBLIGATIONS OF THE PARTIES2.1. The Contractor undertakes to:
· arrange provision of the vehicle at the agreed time;
· ensure the route is carried out in accordance with the Client's order;
· provide information on the trip conditions.
2.2. The Client undertakes to:
· provide correct booking details;
· inform in advance about any group specifics (presence of children, elderly persons, luggage volume, wheelchairs, animals, etc.); otherwise, the Contractor does not guarantee the ability to provide transportation;
· arrive at the pick-up point on time;
· comply with the rules of conduct in the vehicle.
3. PAYMENT AND REFUNDS
3.1. Services are provided at the rates indicated at booking.
3.2. The Order is considered confirmed after the advance payment is made.
3.3. Cancellation is possible no later than 72 hours before the start of the tour or transfer.
3.4. In case of cancellation after the specified period or the Client's no-show, the advance payment is non-refundable.
4. OTHER TERMS
4.1. Any changes to the route, group composition or pick-up time must be agreed in advance.
4.2. Additional stops, change of direction, or increased distance are paid separately.
4.3. The Contractor is not liable for delays caused by traffic congestion, weather conditions, road restrictions, or other circumstances beyond its control.
5. LIABILITY OF THE PARTIES
5.1. The Contractor is liable only for organising the transfer.
5.2. The Contractor is not responsible for:
· the operation of third parties (boats, ferries, parks, hotels, etc.);
· weather conditions and natural factors;
· actions of the Client resulting in delays or inability to perform the transfer.
5.3. The Client is responsible for the safekeeping of their luggage and personal belongings.
6. FORCE MAJEURE
The Parties are released from liability for partial or total failure to perform obligations under the agreement in the event of force majeure circumstances (weather events, road closures, emergencies, political events, etc.).
7. PERSONAL DATA
By placing an order, the Client consents to the processing of their personal data for the performance of the agreement and communications with the Contractor.
8. GOVERNING LAW
The agreement is governed by the laws of the Kingdom of Thailand.
9. TERM OF THE OFFER
The Offer is valid indefinitely from the moment of its acceptance and until termination on the grounds provided by the applicable laws of the Kingdom of Thailand and this Offer.
10. FINAL PROVISIONS
10.1. All disputes between the Parties related to the performance of the Offer are resolved through negotiations.
10.2. Matters not governed by the Offer shall be resolved in accordance with the laws of the Kingdom of Thailand. If any provision of the Offer is deemed void under the laws of the Kingdom of Thailand, the remaining provisions remain in force, and the Offer shall be performed by the Parties in full without regard to such void provision.
